Gas drilling has Back Mountain group concerned

Community partnership members worry about road deterioration, water supplies.

DALLAS TWP. – Lehman Township Supervisor Doug Ide informed members of the Back Mountain Community Partnership Thursday afternoon at Misericordia University about the latest natural gas drilling news in the area.

The BMCP is an inter-municipal group composed of Dallas, Franklin, Jackson, Kingston and Lehman townships and Dallas Borough.

Ide attended a public information session by EnCana Oil and Gas Tuesday at Lake-Lehman Junior/Senior High School. He and the other Lehman Township supervisors have also met with EnCana representatives.

Ide says he learned WhitMar Exploration Company has leased 24,000 acres of property in the northwestern part of Luzerne County, mainly on the north side of Route 118 in Fairmount, Ross, Lake and Lehman townships.

“The gas drilling is going to be here in the Back Mountain,” said Al Fox, BMCP president. “I thought it was quite alarming to hear the other day that 800 people signed up.”

According to Ide, EnCana, which will do the drilling, hopes to form two exploration wells in the county – one in Fairmount Township and one in Lehman Township – if they receive the required permits. The wells will prove whether there is natural gas in the area.

Ide says EnCana is willing to bond any road the township requests. Road deterioration and traffic from heavy trucks and machinery has been a common concern among the BMCP.

“We’re going to set some conditions on some roads we do not want traveled, specifically Old Route 115, Hillside Road,” Ide said.

BMCP officials decided to invite representatives from EnCana to speak at the group’s January meeting.

In February, the BMCP will invite back Brian Oram, a geologist and Wilkes University professor, to discuss what the municipalities should do to safeguard their drinking water and other issues related to drilling.

Oram spoke at the BMCP’s September meeting and briefly touched on water’s involvement in natural gas drilling.

In other news, the BMCP approved each member municipality to contribute $300 each to the group’s proposed 2010 operating budget. The budget is to cover general government administration costs.

WVSA may treat wastewater from gas-drilling

Authority soliciting proposals now to raise money for upgraded pollution controls.

The Wyoming Valley Sanitary Authority is investigating the feasibility of treating wastewater created from natural-gas drilling.

It hopes to offset some cost increases the authority will soon incur to make pollution-reducing renovations.

The authority published a request for proposals earlier this week, seeking bidders who could supply at least 500,000 gallons of wastewater daily for at least three years and pay at least 5.5 cents per gallon. Using both minimums, that would create daily revenue of $27,500.

Drilling for gas in the Marcellus Shale creates millions of gallons of wastewater that must be treated.

“The good part of that is that, instead of paying for fresh water from the Susquehanna (River), we would pre-treat this and they would reuse that to fracture new wells,” said Fred DeSanto, the authority’s executive director. “We know drilling’s going on; we are a wastewater treatment facility. That’s our business to treat it. We just don’t want time to go by as there’s water to treat.”

That means that, for now, the plant is seeking a permit from the state Department of Environmental Protection to treat up to 150,000 gallons per day in its sewage stream. The company, however, is reserving the right to inspect for pollutants in incoming drilling wastewater.

It requires pre-testing for “total dissolved solids” and “suspended solids” – generally a measure of the amount of minerals and chemicals in the water – and reserves the right to deny it.

DeSanto said that protects the authority’s equipment, which would “probably” be damaged by heavy loads of solids.

All testing and transportation costs would be paid by the drilling company, which also must carry $2 million in liability insurance, indemnify the authority from all risks associated with hauling the waste and provide a “blanket statement” that it isn’t “hazardous waste.”

The long-term goal is to build a million-gallon-per-day, closed-loop facility to “pre-treat” the water enough that it could be reused in industrial capacities and resell it to the companies that brought it in.In its bid request, the authority is looking to get at least half a cent per gallon for that water. That water would never touch the sewer operation or be discharged into the river.

“It’s the preferred method of disposal by DEP,” said John Minora, the president PA NE Aqua Resources, which is consulting on the project. “We’re left with a sludge cake that gets either landfilled or incinerated. … The water that’s left, it looks a little milky because it’s high in salt.”

That waste could then be mixed with effluent from the plant’s sewer operation to reduce solids levels, thus preventing more discharges to the river, he said. As pollution discharge credits, which would set a limit for how much facilities can discharge, become a reality, the reduced discharges could provide more revenue.

“I think the people who are environmental should be very happy about that,” Minora said. “Recycle and reuse, I don’t think it has to be an us-against-them” situation.

The revenue would go toward the millions the authority will have to spend to upgrade its system for upcoming requirements to reduce pollution in the Chesapeake Bay and to fix stormwater overflows that currently spill untreated sewage into the river whenever it rains heavily.

Potential revenues are “unknown right now because we don’t exactly what the treatment cost is going to be,” DeSanto said. “We feel that there’s enough there that we could make a profit to help our operating budget in the future, help our ratepayers.”

Bids are due by Nov. 16.

Drilling plan includes recycling

TUNKHANNOCK – As if responding to previous community criticism about a similar facility, company officials hoping to build a drilling-waste treatment plant near Meshoppen said Tuesday recycling water is part of their plans.

“It makes sense to reuse this water,” said Ron Schlicher, an engineer consulting for the treatment company. “The goal here is to strive for 100-percent reuse, so we don’t have to discharge.”

Wyoming Somerset Regional Water Resources Corp. is proposing a facility in Lemon Township in Wyoming County to treat water contaminated during natural-gas drilling in a process called hydraulic fracturing, or “fracking.”

To do so, it requires a National Pollutant Discharge Elimination System permit from the state Department of Environmental Protection.

That process includes a period of public comment, for which the hearing at the Tunkhannock Middle School on Tuesday evening was held.

Wyoming Somerset is the second company to propose such a facility in Wyoming County. Two weeks ago, DEP held a similar hearing for North Branch Processing LLC, which wants to build a plant just outside Tunkhannock in Eaton Township to discharge up to 500,000 gallons daily of the treated waste into the Susquehanna River.

Citizens attending that hearing complained that the discharges could potentially harm the river’s ecology and suggested that the waste simply be recycled into other fracking jobs.

Wyoming Somerset’s proposal is to discharge up to 380,000 gallons daily into the Meshoppen Creek, but company officials said they hoped to sell it all back to drillers instead.

“The discharges need to be in place to make sure that the weather doesn’t have an adverse effect on operations of cleaning the water,” said Larry Mostoller, Wyoming Somerset’s president. “I’ll be willing to drink what we produce. I’ll be willing to drink what comes out of this plant, and you can hold me to that.”

That promise and the vague goal of full reuse didn’t sit well with the roughly 75 citizens who attended the hearing. Questioning everything from why the facility couldn’t guarantee zero discharges to its proposed site, residents came out squarely against the plan.

Many non-residents joined them, including two from Bucks County, one an environmental scientist and the other a lawyer, and a man from New Jersey.

Don Williams, a Susquehanna River advocate from Lycoming County, warned that cashing in on the gas-laden Marcellus Shale is “jeopardizing our land and our feature for the false promise of jobs” and money.

Of particular frustration for many were the unknown details about the plant’s design. Schlicher presented an overview of it, noting reverse-osmosis filters, evaporation tanks and a three-tiered output to provide drillers with water at various levels of treatment.

The water that could potentially be discharged would be “essentially meeting drinking water standards for most things,” Schlicher said, but not everything, including lead, aluminum and iron “because the surface water body can handle them,” he said.

Design specifics won’t be known until the second part of the application, when the company proposes how it will meet its discharge limits. That part likely won’t have a public hearing, DEP officials noted.

Dallas revising zoning to regulate gas drilling

Law will restrict gas wells to specific areas

There’s no natural-gas drilling in Dallas, but that’s not stopping the borough from deciding where it will allow drilling.

As part of the revision of its zoning ordinance, Dallas is adding provisions that would restrict sitting gas wells to areas zoned industrial, highway or business. It would also designate distance setbacks from residences, waterways, streets and wetlands.

The proactive stance is putting Dallas at the forefront of what could become a major issue as drilling in the Marcellus Shale increases.

“You’re talking about a very fundamental conflict between the municipal regulation of land use and the ability of landowner to access land rights,” said Stephen Rhoads, the president of the Pennsylvania Oil & Gas Association. “You could think of this in terms of taking.”

“Taking” is illegally blocking someone’s access to the point of essentially denying their rights. Eventually, it will find its way to court, Rhoads said, though he wouldn’t speculate on who would win.

At its meeting on Thursday, the borough’s planning commission recommended the borough council vote on the revisions.

“The main point is that we were already going through a revision … so we thought it would be proactive to include something that reflects what’s going on in the Back Mountain these days,” Borough Manager Tracey Carr said.

The ordinance would also require drillers to identify roads they plan to use, pay for an engineer to document the roads’ conditions and be responsible for maintenance and repair.

With a flurry of lease signings lately, gas drilling has become a hot topic in the county. Drillers are flocking to the area to tap the Marcellus Shale, a layer of gas-laden rock about a mile underground that stretches from New York to Virginia. Its huge size – and economic potential – has been known for years, but technology only recently caught up to access it.

Despite industry innovations such as horizontal drilling that allow wells to access gas pockets up to a mile away, Rhoads said having versatility in well sites makes “a difference because it depends how much surface area is put off limits. You can’t just put a well site on the edge of town and drill from one well site and get every possible molecule of gas.”

Carr said the provisions aren’t meant to keep drilling out of any areas, “just where would be most appropriate if it was to take place.”

Rhoads said such actions can harm landowners. “The geology will dictate where the well (should be) located – not zoning – and if there’s a conflict between zoning and geology, the geology loses,” he said. “You’re effectively telling me that my oil and gas property is worthless if you zone my surface property in such a way that I can’t gain access to it.”

On the scale of issues facing the industry – including access to water for gas extraction, disposal options for waste and a proposed state severance tax – Rhoads called zoning “a major issue.”

But for Carr and the borough she manages, it’s just being efficient and responsible. “This is actually a very small part of what we’re doing,” she said, noting that the borough’s consultant on the revision suggested adding the drilling provisions.

The proposed ordinance must go through a public hearing and likely won’t be addressed by the council until November or December, she said. There have been no complaints so far, she said, “but we haven’t had the public hearing yet, either.”

Gas drilling may start in ’10

Firm with substantial holdings in Luzerne County taking next step toward exploration.

WhitMar Exploration Co., the only gas-drilling company so far to have leased substantially in Luzerne County, plans to begin drilling by the middle or latter part of next year, according to the company’s president.

“Right now, we’re just filing for some permits for two, possibly three wells we want to drill,” said Whit Marvin, who heads the Denver-based company. “We do plan on drilling it and testing it for the Marcellus Shale.”

Throughout 2009, WhitMar has leased more than 22,000 acres in, among other places, Fairmount, Ross, Lake, Lehman, Union, Hunlock, Huntington and Dallas townships with little money upfront by offering landowners a contractual guarantee to begin drilling within two years.

The contract also guaranteed permitting within the first year, and Marvin said that process is on track. The company is filing for drilling and water-consumption permits from the state Department of Environmental Protection and the Susquehanna River Basin Commission, and is looking into any other permits it might need, he said.

From there, the company will negotiate with the individual landowners about siting for the well pads and gaining access to them, he said.

Much of that will be based seismic testing that’s being done, the results of which Marvin expects before the end of the year. “In essence, you’re using ultrasound. You’re looking for anomalies under the surface … that would be attractive to drill into,” he said. “We can make some geologic interpretation, (but) it’s definitely not an exact science.”

A drilling contractor hasn’t been hired yet, he said, but the company has begun work elsewhere in the shale. It has leased “large blocks” in Lycoming, Wayne and Susquehanna counties, as well as in some counties in New York’s southern tier, he said. Of that, wells are being drilled in Chemung County, N.Y., and preparations for drilling are being made in Susquehanna and Lycoming counties, he said.

In Lycoming County, the industry is moving so fast that companies needing and offering services aren’t able to connect, according to Jeffrey Lorson, an industrial technology specialist at the Pennsylvania College of Technology.

For that reason, the college and a group of organizations interested in the industry are sponsoring a business-networking expo today. Lorson, who heads the college’s Marcellus Shale Education & Training Center, said about 130 vendors are scheduled to be at the free-admission event at the Hughesville Fairgrounds.

Report: Drilling may employ 13,000 by ’12

Needs assessment says most workers would be general laborers with basic skills.

As the natural-gas drilling industry ramps up in Pennsylvania’s Marcellus Shale, it could employ perhaps 13,000 workers by 2012, the vast majority of them general laborers with basic skill sets, according to a needs assessment released last week by the Marcellus Shale Education & Training Center.

“There’s going to be a significant amount of folks needed across many occupations, but the bulk of the activity when it’s in the drilling phase – up to 75 percent – is going to require some entry level of the industry, but not necessarily a degree, which is a good opportunity for most folks who are displaced … by the economy,” said Jeff Lorson, an industrial technology specialist at Penn College in Williamsport.

The report focuses on the 13 counties in the Northern Tier and Central regions of the state Workforce Investment Board, but Lorson noted that the report assessed only direct employment by the industry, so jobs created in other industries to serve or support the drilling industry would raise the number.

The 13 counties do not include Luzerne, but do include all those on its western and northern borders: Wyoming, Sullivan and Columbia.

The report made “low,” “likely” and “high” estimates for positions in three phases: pre-drilling, drilling and production.

The vast majority would be needed in the pre-drilling and drilling phases, in which jobs are short-term and require regular relocation but limited skills. The assessment found that each well drilled would require “more than 410 individuals working within nearly 150 different occupations,” the total hours worked by them equaling about 11.53 full-time workers. The number of workers is linked to the number of wells drilled, however, so it would be reduced whenever the industry contracts.

A much smaller number of jobs would be required for production, but those jobs would be long-term and require more-specific skills. It would take about six wells to create one of these jobs, the assessment reports, but the jobs compile, so new jobs are being created over the years whenever wells are drilled.

Using a multiplier created by the Pennsylvania Economy League, the report suggests that nearly 20,000 non-industry jobs would be created by industry activities in the Northern Tier and Central regions.

Penn College is using the report’s results to refine its educational offerings through the shale training center. It will begin a “roustabout” program, Lorson said, that will provide general industry knowledge, occupational safety training and environmental awareness.

“They have a real feeling in the industry to start at the bottom and work their way up,” he said.

The report’s results jibe with the industry’s own assessment in 2006, according to Stephen Rhoads, the president of the Pennsylvania Oil & Gas Association. “They’re finding out what we’ve already known,” he said, adding that the industry is talking about setting up a statewide education program in high schools, vocational schools and higher-education institutions to prepare basic workers but also provide the education needed for advancement.

He pointed to a program in place at the University of Pittsburgh at Bradford in which rig workers take night classes to earn an associate’s degree needed for jobs to assist geologists and engineers.

“Many of the jobs in the industry that are in highest demand are people who man the drilling rigs and well servicing crews and people” who manage well sites, he said. “They don’t require advanced degrees. You need a good worth ethic, a high school diploma, and in many cases you have to be able to qualify for a driver’s license.”

Pa. action may affect gas drilling

Bill, 2 Supreme Court decisions could alter how operations are taxed, located.

Three recent state-level actions – a legislative bill and two state Supreme Court decisions – could affect how natural gas wells are sited and taxed. Earlier this week, state Rep. Bill DeWeese, D-Greene County, proposed a bill to tax underground gas deposits by adding their assessed values to property taxes. The driller would pay, and the tax revenue would, for the first year, be used to reduce the municipality’s millage to equal the previous year’s tax revenue. The millage – a dollar tax on every $1,000 of assessed property value – could be increased in subsequent years.

“If a municipality needs the same amount of money as last year, then yes, the millage would go down. But, the reality is they’re probably going to keep ours the same and get more money from them (the drillers),” said Marianne Rexer, a business professor at Wilkes University.

The bill is in response to a 2002 state Supreme Court decision that no law exists to tax natural gas, as there does to tax coal and other minerals.

Stephen Rhoads, president of the Pennsylvania Oil and Gas Association, said the tax wasn’t utilized by many counties before, and “it is a false hope that this is going to bring a revenue stream to counties and school districts any time soon.”

The state Supreme Court ruled in February on two western Pennsylvania cases regarding municipalities’ rights to restrict drilling.

In one case, the court found municipalities can’t control where drilling infrastructure is permitted, as that would interfere with regulations already promulgated in the state Oil and Gas Act.

But they can indicate in which zoning districts drilling may be allowed “in recognition of the unique expertise of municipal governing bodies to designate where different uses should be permitted in a manner that accounts for the community’s development objectives,” the court’s opinion states in the other case.

The ruling might not have much effect in the Northeastern Pennsylvania municipalities of interest to drillers. Many don’t have zoning ordinances, and others, such as Fairmount Township in northwest Luzerne County, want less restrictive ones.

Several landowners have sought drilling leases, township Supervisor David Keller said, and he has no interest in restricting their options. The township now yields to the county’s Planning and Zoning office, but Keller said the township is looking into writing its own zoning ordinance because “it would give us more leeway to let people do more with their property as they see fit.”

College in Williamsport preparing workers

WILLIAMSPORT – Like many of his classmates, Mike Harris already has a job in electricity-generation lined up for when he graduates this spring.

Mike Harris of Dalton cools a piece of metal in a quench tank at Pennsylvania College of Technology Marcellus Shale Education & Training Center. After he earns his degree in welding later this year, he’s taking a job in Illinois. The college’s new center would help students like him land jobs in the local gas drilling industry.

The only problem is it will require the Dalton native to relocate to Illinois.

Soon enough, though, future students in these same welding classes at Pennsylvania College of Technology could be in a curriculum that funnels them into local jobs with natural gas drillers working in the Marcellus Shale region.

The Marcellus Shale Education & Training Center at the college is in its early infancy, only envisioned late last year and opened earlier this year, but plans are for it to expand quickly.

A collaboration with the Penn State Cooperative Extension, the center will identify the industry’s work force needs and respond with education tracks that train people for those jobs, said Jeffrey Lorson, an industrial technology specialist at the college who’s running the training center.

“With the escalation and the things with the Marcellus, there was clearly a need in the work force,” he said. “We knew we had a tremendous fit to support the industry.”

The jobs are certainly here, Harris said, and there aren’t enough local workers. “They can’t find anybody,” he said about drillers.

Lorson’s family has a motel in Bainbridge, N.Y., near Binghamton, and the place is constantly packed. “There’s guys coming from all over the place” to work for the drilling companies, he said.

He felt Penn College graduates would be “competitive” for jobs in the industry, which could feed off the college for workers in fields from welding to heavy machinery operation.

“The center has the potential to provide very meaningful training options for local residents,” said Stephen Rhoads, the president of the Pennsylvania Oil & Gas Association. Certain skills, such as building and maintaining infrastructure and inspecting gauges and other moveable parts, “are all skills that could very easily find a home up in Northeastern Pennsylvania,” he said.

“If the industry grows as we expect it to, there will be long-term career opportunities.”

While he plans to enjoy traveling while starting his career, Harris said he’s looking ahead to hometown job security.

“I feel very confident, and I’d love to stay in Northeastern Pennsylvania, but right now as things are starting to take off, I think it’s easier for me to leave and get some experience,” he said.

The center could also help students outline career paths, an idea Harris has already considered. He’s planning to become certified in visual inspections.

“It keeps me out in the field, but it’s managerial,” he said. “You’re in the middle, which is pretty much where I wouldn’t mind being.”

The hearing at Misericordia University was organized by the state Senate Republicans’ policy committee to identify potential problems with drilling the Marcellus Shale about a mile underground, but the senators instead were told that many of the problems lie with the state itself.

“Fundamentally, what the industry has said to us is, ‘We need to know what the rules are,’” said Tom Beauduy, the deputy director of the Susquehanna River Basin Commission. The commission oversees water removal from the river basin.

Industry representatives were dire with their characterizations. The industry is experiencing “permitting delays unlike we have ever seen in any other state,” said Wendy Straatmann, president of Ohio-based Exco-North Coast Energy Inc. “Why would I spend so much of our company’s time and resources when I can go to some other state and use the gas and oil manual and follow the regulations?”

Ray Walker, a vice president with Texas-based Range Resources Corp., agreed that an inclusive regulations manual would help companies “put our money into protecting the environment and not paperwork.” He noted that smaller companies are considering drilling here, but won’t if the permitting process remains slow and taxes increase. That could keep development slow, he said.

That’s a prospect that few at the hearing wanted. John Hanger, the acting secretary of the state Department of Environmental Protection, assured that his agency was “working to make sure that gas can be produced and water protected.” Part of the lag has come from a dearth of disposal options for the fluids used to hydraulically fracture the rock, and Hanger said his favored alternative was to find ways for the companies to simply inject them underground.

DEP would need to increase its regulatory force to keep up with the permitting and inspections demand predicted based on industry desires, he said, noting the department has recently requested substantially increasing its well-permitting fees.

Still the Republican senators felt DEP is clamping down too tightly. “When I ran for Senate, I was mad at the state for over-regulating my industry,” said Sen. Mary Jo White, R-Venango County, who had worked for an oil corporation. “I think we’re heading down that road again.”

William Brackett, the managing editor of a newsletter that reports on the Barnett Shale, said gas drilling there “is a prime reason the north Texas economy has only caught a cold and not the flu.”

John Hanger, the acting secretary of the state Department of Environmental Protection, assured that his agency was “working to make sure that gas can be produced and water protected.” Part of the lag has come from a dearth of disposal options for the fluids used to hydraulically fracture the rock, and Hanger said his favored alternative was to find ways for the companies to simply inject them underground.

DEP would need to increase its regulatory force to keep up with the permitting and inspections demand predicted based on industry desires, he said, noting the department has recently requested substantially increasing its well-permitting fees.

Still the Republican senators felt DEP is clamping down too tightly. “When I ran for Senate, I was mad at the state for over-regulating my industry,” said Sen. Mary Jo White, R-Venango County, who had worked for an oil corporation. “I think we’re heading down that road again.”

William Brackett, the managing editor of a newsletter that reports on the Barnett Shale, said gas drilling there “is a prime reason the north Texas economy has only caught a cold and not the flu.”
